Kansas Craigslist Sperm Donor Twist

A new twist in the Craigslist sperm donor case in Kansas has emerged. Back in 2009, a same-sex couple sought out a sperm donor via Craigslist so they could start a family. The two women and the man they found signed an agreement and a baby was conceived. Fast forward some time and the women ended their relationship, leaving the biological mother and child to apply for state assistance. Since the three did not use a doctor during the artificial insemination, the state found that the biological father was to be financially responsible, causing a big legal battle.

This past week, the lawyer representing the 3-year old girl filed a motion seeking input from a mental health expert. She believes having a psychologist evaluate the child and recommend whether it would be beneficial to introduce the sperm donor in her life, is the best solution. The nonbiological mother is still involved in the girl’s life and filed a motion last week seeking to intervene in the child support case. Her attorney is citing a Kansas Supreme Court ruling that the nonbiological mother of children in a sam-sex relationship can have the same parental rights as the biological mother. According to her attorney, the two women intended to enter into a parenting plan which they had hoped to have approved by the court. The state is currently opposing the motion.
