Why a Contract Can Make a Difference

A new judgement in the United Kingdom could potentially affect thousands of couples. The ruling which permits men who help families conceive allows them the ability to win the right to play a part in the life of the child. According to the ruling by the High Court, a sperm donor does not need to have  a sexual relationship with a mother in order to influence the child’s upbringing.

Experts are warning that this ruling could have “far-reaching” consequences on couples, both heterosexual and gay, who are considering using a sperm donor. More on the specific case that led to this ruling can be found here.

Anyone who is seeking the use of a sperm donor through a more personal setting and not through a paid medical setting, should highly consider entering in to a contract with the donor prior to engaging. Taking the time to set boundaries and precedents can help alleviate future potential situations that my arrise. Especially in cases like the one above, where the donor was a friend, contracts should be high priority. It’s important to note that this is a UK ruling and here in the United States, even with a contract, not every state will recognize said contracts, and it’s vital to do your research before executing one.
