Court Ruling: Biological Father Has No Custody or Paternity Rights

Actor Jason Patric has lost a custody and paternal rights battle with his ex-girlfriend. A judge ruled against him despite never having done anything wrong. The couple who were together for numerous years split up in 2009. At the time of the breakup, Patric offered his sperm to his ex provided he had nothing to do with raising the child and that she would not later seek child support.

Later that year, his ex-girlfriend was artificially inseminated and gave birth to her son. There was no contact from Patric during a two year period but in 2011, the couple reconnected and once again dated. During this time, Patric formed a relationship with his biological son and when the couple split up once again, Patric sought out his parental rights.

It’s unknown if the couple had drafted legal documents stating their wishes prior to the child being born. It’s an unfortunate situation that has left a biological father with no legal rights to ever see his son again. Regardless if there was a contract or not, the judge in this case made his ruling and essentially is keeping a father from his son. It’s important to note that each state has different laws regarding donating sperm. Before entering into such an arrangement, it’s best to seek legal advise from an attorney within your state.
